Language
This document is published in several languages for your convenience. The English version is the legally binding version. Where a translation differs from the English text, the English text prevails.
1. Introduction
These Website Terms of Use ("Terms") govern your access to and use of capitalacademy.ai and its publicly accessible pages, including class, certification, bundle, expert and pricing pages, our about, accreditation and scholarship information, events and podcasts, the Influence Network, our contact and enquiry forms, the certificate verification service, and any other publicly available content (together, the "Website").
The Website is operated by Capital Academy Tech Ltd., a company incorporated in the Dubai International Financial Centre (DIFC), Dubai, United Arab Emirates, under DIFC Licence No. CL9551 ("Capital Academy", "we", "us", "our").
These Terms apply to every visitor, regardless of whether you create an account, enrol in a class, subscribe to anything, or simply read a page. By accessing the Website you confirm you have read, understood and agree to be bound by them. If you do not agree, please stop using the Website.
These Terms cover the public website only. The moment you create an account, buy anything, sit an assessment or use CAPA, the Learner Terms of Service govern that relationship, and prevail over these Terms to the extent of any conflict.
Read these Terms together with our Privacy Policy, Cookie Policy, Learner Terms of Service, Refund & Cancellation Policy and Copyright & Trademark Notice.
2. What the Website is for
Capital Academy is an education technology company delivering AI-supported professional education in finance, investment, capital markets, business and related disciplines. The Website is our public presence and exists to tell you what we offer and let you enrol.
Through it we publish information about:
- classes, bundles, certification programmes and pricing
- our experts and the institutions we partner with, including the American University in Dubai
- accreditations, scholarships and CPD recognition
- solutions for businesses, universities and teams
- events, webinars and podcasts
- the Influence Network
- company news and general educational information
Unless we expressly say otherwise, everything published on the Website is general information and marketing material. Course descriptions, durations, outcomes, instructor listings and prices are accurate at the time of publication but may change. The terms shown at checkout are the ones that apply to your purchase.
3. Accepting these Terms
By using the Website you represent that you have the legal capacity to enter into a binding agreement under the law applicable to you, that you will comply with these Terms and all applicable laws, that you will use the Website only for lawful purposes, and that any information you submit through it is accurate and not misleading.
If you are using the Website on behalf of an organisation, you confirm you are authorised to bind that organisation, and "you" includes it.
We may update these Terms from time to time. The current version is always published on this page with its effective date, and continued use after a revision takes effect means you accept it.
4. Who may use the Website
The Website is intended for people who have reached the age of majority in their jurisdiction. Younger learners may access our services only through a designated youth programme with verified parental or guardian consent, or through an authorised school or institution. See the Learner Terms of Service.
We may restrict or refuse access where necessary to comply with applicable law, sanctions regimes, export controls, licensing requirements, court orders or regulatory obligations, or where we reasonably believe the Website is being misused.
5. What you may do
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Website for your own personal, non-commercial, informational purposes.
Within that licence you may:
- browse and read publicly available pages
- view a single copy of a page on screen and print it for your own reference
- share a link to a public page
- download material we have expressly made available for download, on the terms stated with it
- use the certificate verification service to confirm a specific credential
- contact us through our enquiry forms
This licence grants no ownership and may be withdrawn at any time. All rights not expressly granted are reserved.
6. What you must not do
You must not:
- copy, reproduce, republish or redistribute Website content beyond the limited licence above
- scrape, crawl, spider, index or harvest the Website or its content by automated means, except that well-behaved search-engine crawlers may index public pages
- use Website content to train, fine-tune, evaluate or benchmark any artificial intelligence or machine-learning model
- extract or compile data from the certificate verification service, or use it to build a database or directory of learners
- collect email addresses, expert profiles or other personal information from the Website
- frame, mirror or embed the Website in a way that misrepresents its origin
- remove, obscure or alter any copyright, trademark or ownership notice
- circumvent technical content-protection measures, access tokens or paywalls
- probe, scan or test the vulnerability of the Website except as permitted in section 12
- interfere with or disrupt the Website, overload it, or attempt a denial-of-service attack
- upload or transmit malicious code, or use the Website to distribute it
- impersonate Capital Academy, our experts or another person
- use the Website for unlawful, fraudulent, deceptive or misleading purposes
- use the Website to build a competing product or service
Automated collection of Website content for AI training is expressly prohibited. Publishing content openly is not permission to ingest it. See the Copyright & Trademark Notice.
7. Accounts and the learning platform
Some areas of capitalacademy.ai are restricted to signed-in learners: the dashboard, class content, assessments, CAPA and everything behind a purchase. Access to those areas is governed by the Learner Terms of Service, not by these Terms.
You must not attempt to access a restricted area you have no right to, use another person's credentials, or share your own. AI services are not available to visitors who are not signed in.
8. Accuracy of Website content
We take reasonable care to keep the Website accurate and current, but we do not warrant that it is complete, accurate or up to date at all times. Errors and omissions can occur, and we may correct them without notice.
Class catalogues, curricula, instructor and expert listings, durations, accreditation statements, availability and pricing may change. Nothing on the Website is an offer capable of acceptance. A contract is formed only when you complete a purchase on the terms presented at checkout.
Where we publish figures, market examples, case studies or sample outcomes, they are illustrative and may be simplified, historical or hypothetical. Learner outcomes vary and past results do not predict future ones.
9. AI-assisted content
Some material published on the Website may be generated or assisted by artificial intelligence, including summaries, translations and supporting copy. Our experts and editorial team review published material, but AI-assisted content can still contain inaccuracies.
CAPA, our AI learning assistant, is not available on the public Website. It sits behind sign-in and, for most features, an entitlement. Where we make any public demonstration of AI available, it is illustrative only, may be limited or withdrawn at any time, and must not be relied on.
AI-generated content is never professional advice. Section 16 applies to it in full.
10. Intellectual property and trademarks
The Website and everything on it (text, class descriptions, curricula, graphics, photography, video, audio, illustrations, icons, page design, user interface, layout, code and compilation) is owned by Capital Academy or its licensors and protected by copyright, trademark, database and other intellectual property laws.
"Capital Academy", "CAPA", our logos, certification names, slogans and other distinctive brand elements are trademarks or proprietary marks of Capital Academy or its licensors. You may not use them in company names, domain names, product names, advertising, social media accounts or promotional material without our prior written permission.
Partner institution marks, including those of the American University in Dubai, remain the property of their owners and may not be used without that owner's permission. Third-party names and marks appearing on the Website are the property of their respective owners.
If you believe material on the Website infringes your intellectual property rights, send a written notice to support@capitalacademy.ai identifying the work, the material complained of and where it appears, with your contact details and a statement that you believe the use is unauthorised and that your information is accurate. Our full notice is in the Copyright & Trademark Notice.
11. What you send us
When you use a contact, enquiry, business or partner form, or otherwise send us material through the Website, you confirm the information is accurate, that you are entitled to send it, and that it does not infringe anyone's rights or contain malicious code.
Do not send confidential or sensitive information through public Website forms. Unless we have agreed otherwise in writing, material you send us through the Website is not treated as confidential.
If you send us suggestions, ideas or feedback about our services, you agree we may use them without restriction, obligation or compensation. We handle personal information you submit in accordance with the Privacy Policy.
12. Website security and responsible disclosure
You must not attempt to gain unauthorised access to the Website, its servers, databases or any connected system, or to defeat authentication, rate limiting, bot protection or content protection.
We welcome good-faith security research. If you believe you have found a vulnerability, report it privately to support@capitalacademy.ai before disclosing it to anyone else, and give us reasonable time to fix it. Do not access or modify data that is not yours, do not degrade the service, and do not use automated scanning that generates disruptive load.
We will not pursue action against researchers who follow this approach in good faith. Testing that goes beyond it (including data exfiltration, social engineering of our staff or learners, and denial-of-service testing) is not authorised.
13. Third-party links and embedded content
The Website links to and embeds third-party content and services, including video players, payment processing and bot protection. Those services are controlled by their providers and governed by their own terms and privacy notices.
A link is not an endorsement. We are not responsible for the content, availability, accuracy or practices of any third-party site or service, and you access them at your own risk.
14. Privacy and cookies
Our Privacy Policy explains what personal information we collect through the Website, why, who we share it with and what rights you have. Our Cookie Policy lists the cookies and similar technologies we use and how to control them.
We do not use advertising cookies or third-party marketing trackers, and we do not sell personal information.
15. Availability and changes
We aim to keep the Website available but do not guarantee uninterrupted, timely, secure or error-free access. Availability may be affected by maintenance, upgrades, technical faults, third-party outages or events beyond our control.
We may change, suspend, restrict or discontinue any part of the Website, or any content or feature, at any time and without notice, and we are not liable to you for doing so.
16. Educational and investment disclaimer
Everything on this Website is general information for education only. Nothing on it is financial, investment, legal, tax or accounting advice, or a recommendation to buy or sell any security or financial instrument.
Capital Academy is an education provider. We do not provide financial advisory services, investment management, brokerage, regulated investment services, legal advice or tax advice, and nothing on the Website creates a professional-client relationship.
Financial markets involve risk, including loss of capital. Past performance does not guarantee future results. You are solely responsible for any decision you make on the basis of information found here, and you should take advice from an appropriately licensed professional in your jurisdiction before acting.
To the fullest extent permitted by law, the Website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
17. Limitation of liability and indemnity
To the fullest extent permitted by law, Capital Academy and its directors, officers, employees, experts, partners, licensors and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for loss of profits, business opportunity, goodwill or data, arising from or relating to your use of or inability to use the Website, any interruption or error, your reliance on Website content or AI-assisted content, or any third-party site or service.
Where liability cannot be excluded, our aggregate liability arising out of or relating to your use of the Website shall not exceed the greater of the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, and the minimum amount required by applicable law.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
You agree to indemnify and hold harmless Capital Academy and the people listed above against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, your infringement of third-party rights, or your unlawful conduct.
18. Governing law and disputes
These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) are governed by the laws of the Dubai International Financial Centre (DIFC), and the courts of the DIFC have exclusive jurisdiction.
Before starting formal proceedings, both parties agree to try to resolve the dispute in good faith. Nothing in this section limits any mandatory consumer right, or your right to bring proceedings in the courts of your country of residence, where such rights cannot lawfully be excluded.
19. General
If any provision of these Terms is found invalid, illegal or unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it.
You may not assign your rights or obligations under these Terms. We may assign them in connection with a merger, acquisition, restructuring or sale of assets.
We are not liable for any failure or delay caused by events beyond our reasonable control. These Terms are published in several languages; the English version is legally binding and prevails in the event of any inconsistency.
